These Terms and Conditions (“Terms”) govern your use of the Winner’s Circle website and your participation in communications and recruiting activities related to opportunities to become an independent life insurance agent with Winner’s Circle.
By accessing or using this website, submitting information through a form, scheduling an appointment, or otherwise interacting with Winner’s Circle through this website, you acknowledge these Terms. Your consent to receive SMS/text messages is governed separately by the SMS consent presented when you provide your mobile telephone number.
1. About Winner’s Circle
Winner’s Circle provides recruiting, training, onboarding, and business-development resources for individuals who are interested in opportunities as independent life insurance agents.
The recruiting information available through this website is intended to help prospective agents learn more about the opportunity, insurance licensing, contracting, onboarding, training, and operating as an independent life insurance agent.
For purposes of these Terms, “Winner’s Circle,” “we,” “us,” and “our” refer to Winner’s Circle and its applicable business operations.
2. Recruiting and Independent Agent Opportunities
Winner’s Circle uses this website to provide information to individuals interested in potential opportunities as independent life insurance agents.
Submitting an inquiry or application through this website does not create an employment relationship, independent-contractor relationship, insurance carrier appointment, partnership, or other contractual relationship between you and Winner’s Circle.
Submission of information also does not guarantee that you will be accepted, contracted, licensed, appointed, or otherwise affiliated with Winner’s Circle or any insurance carrier.
Prospective agents may be required to satisfy applicable state licensing requirements, background requirements, carrier contracting requirements, training requirements, and other eligibility requirements before conducting insurance business.
Unless Winner’s Circle expressly states otherwise in a separate written agreement, opportunities presented through this recruiting website are independent-contractor opportunities and are not offers of salaried employment.
3. Insurance Licensing and Carrier Appointments
Individuals generally must obtain and maintain all licenses, appointments, certifications, and other authorizations required by applicable law and individual insurance carriers before conducting insurance activities that require such authorization.
Insurance licensing and carrier appointment requirements may vary by jurisdiction and carrier.
Winner’s Circle does not guarantee that any individual will qualify for an insurance license, carrier appointment, contract, or particular insurance product.
4. No Guarantee of Income or Business Results
Winner’s Circle does not guarantee any particular amount of income, commissions, sales, production, advancement, leads, clients, or other business results.
Any compensation examples, testimonials, production figures, sales examples, or discussions regarding potential earnings are provided for informational purposes and should not be interpreted as promises or guarantees of future performance.
Individual results vary and may depend on numerous factors, including individual effort, skill, experience, licensing, training, sales activity, market conditions, lead availability, carrier requirements, product availability, and individual performance.
Prospective agents should independently evaluate the costs, responsibilities, risks, and potential benefits associated with operating as an independent insurance agent.
5. Information You Submit
When you submit information through Winner’s Circle, you agree to provide accurate information to the best of your knowledge.
Information you provide may include your name, email address, telephone number, location, licensing status, professional background, appointment preferences, and other information reasonably necessary to respond to your inquiry or evaluate your interest in the independent agent opportunity.
If you provide a telephone number or email address, you represent that you are authorized to use that telephone number or email address.

6. Recruiting Communications
If you submit an inquiry regarding an independent agent opportunity, Winner’s Circle may use the contact information you provide to respond to your inquiry and communicate with you regarding the opportunity, subject to applicable law and the communication permissions you provide.
Communications may concern recruiting inquiries, business-opportunity meetings, interviews, appointment scheduling and reminders, insurance licensing, contracting, onboarding, training, carrier information, and other matters related to your interest in becoming or operating as an independent life insurance agent with Winner’s Circle.
7. Winner’s Circle SMS Messaging Program
Winner’s Circle offers an SMS/text messaging program for prospective agents who expressly opt in to receive text messages.
If you separately provide your mobile telephone number and affirmatively consent to receive SMS communications, Winner’s Circle may send recurring conversational and informational text messages concerning your inquiry and the independent life insurance agent opportunity.
Messages may include recruiting follow-ups, responses to your inquiry, interview and appointment scheduling, appointment reminders, insurance licensing information, contracting and onboarding information, training information, and other communications directly related to the independent agent opportunity.
Message frequency varies. Message and data rates may apply.
Your mobile carrier’s standard messaging and data rates may apply to messages sent to or received from Winner’s Circle.
Consent to receive SMS communications is not a condition of purchase.
8. SMS Opt-Out — STOP
You may cancel the Winner’s Circle SMS messaging service at any time by replying STOP to a message from Winner’s Circle.
After you send STOP, you may receive a confirmation message indicating that you have been unsubscribed. After your opt-out request has been processed, Winner’s Circle will no longer send messages to that number through the applicable SMS program unless you subsequently provide consent to receive messages again.
If you later wish to receive SMS messages again, you may opt in again through an available Winner’s Circle opt-in method.
9. SMS Assistance — HELP

Winner’s Circle will provide reasonable assistance regarding the messaging program.
10. Message Delivery and Wireless Carriers
Wireless carriers are not responsible for the content of Winner’s Circle communications.
Carriers are not liable for any delayed or undelivered messages.
Message delivery is subject to the effective transmission and operation of your wireless service provider’s network and therefore cannot be guaranteed.
Winner’s Circle is not responsible for delays or failures in message delivery caused by circumstances outside its reasonable control.
11. SMS Consent and Privacy
Winner’s Circle respects the privacy of prospective agents and individuals who communicate with us.
SMS consent is collected separately from general website use. Where a website form contains an SMS consent checkbox, the user must affirmatively select the checkbox to provide the applicable SMS consent.
We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes.

Your consent to receive SMS messages is separate from any other communication permissions and may be withdrawn as described in the SMS section above.
13. Website Use
You may use the Winner’s Circle website only for lawful purposes.
You agree not to use the website to:
Submit knowingly false, fraudulent, or misleading information;
Impersonate another person;
Attempt to gain unauthorized access to systems or information;
Interfere with the security or operation of the website;
Introduce malicious software, code, or other harmful material;
Scrape, copy, reproduce, or exploit website content in an unauthorized manner; or
Engage in activity that violates applicable law.
Winner’s Circle may restrict access to the website where reasonably necessary to protect its systems, users, intellectual property, or business operations.
14. Third-Party Services and Insurance Carriers
Winner’s Circle may provide information concerning or access to third-party insurance carriers, technology providers, licensing resources, training providers, lead providers, scheduling systems, or other third-party services.

Unless otherwise stated, the Winner’s Circle name, branding, website content, graphics, videos, training materials, written materials, designs, and other proprietary content made available through this website are owned by or licensed to Winner’s Circle.
Nothing in these Terms grants you ownership of Winner’s Circle intellectual property.
You may not reproduce, distribute, modify, publish, sell, license, or commercially exploit Winner’s Circle proprietary content without appropriate authorization.
